Applying for a Work Permit in Thailand
Any foreign national intending to work in Thailand must obtain a valid work permit prior to commencing employment. Under Thai law, the term “work” is broadly defined as any activity involving the application of physical effort or intellectual skill—regardless of whether it is compensated with wages or other forms of remuneration.
The authority responsible for issuing work permits is the Ministry of Labour. Pursuant to Section 8 of the Foreign Business Act, a prospective employer in Thailand may submit the work permit application on behalf of the foreign employee. However, the permit itself will only be granted once the applicant has lawfully entered Thailand under the country’s immigration regulations and has appeared in person to finalize the process.
Importantly, a work permit cannot be issued to a foreigner who does not hold a non-immigrant visa. In Thailand, work permits are job-specific and company-specific—granted to individuals supported by a registered Thai company for a designated role. The permit does not authorize employment beyond the scope of that company or position. Therefore, if a foreign national secures employment prior to relocating to Thailand, the employing company should assist in obtaining a non-immigrant B visa in advance.
Upon entry into Thailand with a non-immigrant B visa, the individual must apply for—or collect—the work permit within the validity of the visa. This process requires submission of various corporate documents by the sponsoring company. Once the work permit is granted—typically for the same duration as the visa—the foreign employee may apply to extend the visa from an initial 90-day period to a full one-year stay.
Following this, as long as the individual maintains legal residence and continuous employment in Thailand, both the visa and work permit may be renewed annually, provided that all renewal requirements are met prior to the expiration date.
One-Year Multiple-Entry Non-Immigrant B Visa
The one-year multiple-entry Non-Immigrant B visa is primarily granted based on the applicant’s stated purpose and supporting documentation. Once approved and issued by a Thai embassy or consulate abroad, the visa must be activated within one year from the date of issuance. While it permits unlimited entries into Thailand during its validity, the visa holder is required to depart and re-enter the country at least once every 90 days. This can be done via air, land, or sea, in order to maintain lawful immigration status.
